Part 1. Terms of Service
Article 1 (Purpose)
The purpose of these Terms is to establish the conditions and procedures for using the travel-related services (the "Services") provided through the PADA website (the "Site") operated by PADATOUR INC. (the "Company"), as well as the rights, obligations, and responsibilities of the Company and Users.
Article 2 (Definitions)
- "Services" means tour reservations, car rental reservations, restaurant reservations, and other travel-related services provided through the Site operated by the Company.
- "User" means a customer who accesses the Site and uses the Services provided by the Company in accordance with these Terms.
- "Reservation" means a User's advance application for a tour, car rental, restaurant, or other service through the Services.
- "Partner" means a third-party business that has entered into an agreement with the Company to provide goods or services through the Services.
- "Directly Provided Services" means travel services that the Company provides to Users in its own name and under its own responsibility, including Miyakojima marine tours. The Company entrusts the reservation processing and local operations management in Japan for Directly Provided Services to 株式会社PADA, an operator located in Japan (the "Local Operator"), and the Local Operator performs those duties pursuant to the reservation agency and operations management outsourcing agreement entered into with the Company. The Local Operator is an independent business with no capital relationship with the Company and is not a subsidiary, affiliate, or branch of the Company. The Company bears contractual responsibility toward Users.
- "Brokerage Services" means services through which the Company connects Users with Partners' products, including car rental reservations, scuba diving, and restaurant reservations. With respect to Brokerage Services, the Company is a mail-order intermediary under Article 2, subparagraph 4 of the Act on Consumer Protection in Electronic Commerce, Etc., and is not a party to the relevant transaction.
Article 3 (Effectiveness and Amendment of Terms)
- These Terms become effective when they are posted on the Site or otherwise announced to Users.
- The Company may amend these Terms to the extent that such amendment does not violate applicable laws and regulations.
- When the Company amends these Terms, it will specify the effective date and reason for the amendment and post them on the Site together with the current Terms beginning at least 7 days before the effective date. However, an amendment unfavorable to Users will be announced beginning at least 30 days before the effective date, and Users will also be notified individually through their registered email addresses or similar means.
- A User who does not agree to the application of the amended Terms may discontinue use of the Services and terminate the service agreement.
Article 4 (Provision of Services)
- The Company provides the following Services:
- a. Directly Provided Services: Miyakojima marine tours, including SUP, snorkeling, Yuninohama tours, and Yabiji tours. The Company is the contracting party, while reservation processing and local operations are entrusted to the Local Operator.
- b. Brokerage Services: Miyakojima car rentals, Ishigakijima car rentals, Miyakojima scuba diving, Miyakojima restaurant reservations, and similar services
- c. Travel information services
- d. Other services determined by the Company
- In principle, the Services are available 24 hours a day, 365 days a year. However, the Services may be temporarily suspended due to scheduled system maintenance, server failures, natural disasters, or similar circumstances.
Article 5 (Reservations and Payments)
- A User applies for a Reservation by entering reservation information in the form provided on the Site.
- A Reservation is formed when the Company or a Partner confirms it.
- Payment is made through a payment method provided by the Company, and the Reservation is confirmed when payment is completed.
- A User must provide accurate information when making a Reservation. The Company is not liable for problems arising from inaccurate information provided by the User.
Article 6 (Reservation Cancellations and Refunds)
- A User may cancel a Reservation in accordance with the standards set forth in the "Refund and Cancellation Policy."
- Refunds are processed according to the time of cancellation and the cancellation policy applicable to each product.
Article 6-2 (Right of Withdrawal)
- Pursuant to Article 17(1) of the Act on Consumer Protection in Electronic Commerce, Etc., a User may withdraw from the contract within 7 days from the date the User receives a written document concerning the terms of the contract, such as a reservation confirmation email.
- However, the right of withdrawal may be restricted pursuant to Article 17(2) of the same Act in any of the following cases:
- a. Where the product is a tour scheduled for a specific date of use and the value of the service has substantially diminished over time to the extent that resale has become difficult
- b. Where provision of the service has already commenced
- The Company will clearly inform the User of the grounds for restricting the right of withdrawal under paragraph 2 when confirming the Reservation.
Article 7 (User Obligations)
- Users must comply with these Terms, applicable laws and regulations, and matters announced by the Company.
- Users must not misappropriate another person's information or provide false information.
- Users must not engage in conduct that interferes with the normal operation of the Services.
Article 8 (Protection of Personal Information)
The Company protects Users' personal information in accordance with applicable laws and regulations. Matters concerning the processing of personal information are governed by the "Privacy Policy" separately published by the Company.
Article 9 (Liability)
- If a User suffers damage due to operational circumstances attributable to the Local Operator in the course of providing Directly Provided Services, the Company bears contractual liability toward the User. The Local Operator acts as the Company's assistant in performance, and the internal allocation of liability and rights of recourse between the Company and the Local Operator are governed by the outsourcing agreement between them.
- For Brokerage Services, the Company is a mail-order intermediary and is not a party to the transaction. In principle, the relevant Partner is responsible for defects in the goods or services it provides. However, the Company is liable for damage arising from its failure to fulfill the disclosure obligations under Article 20-2 of the Act on Consumer Protection in Electronic Commerce, Etc., and for damage caused by the Company's willful misconduct or gross negligence.
- The Company is not liable for damage arising from causes for which the Company is not responsible, including natural disasters or causes attributable to the User.
Article 10 (Dispute Resolution and Jurisdiction)
- In principle, disputes between the Company and a User will be resolved amicably through mutual consultation.
- The court having jurisdiction over the location of the Company's principal office will have jurisdiction over disputes relating to these Terms. However, if the User's address or place of residence is clear at the time an action is filed, the court having jurisdiction over the User's address or place of residence under the Civil Procedure Act will also have jurisdiction. If the User is a consumer, an agreement conferring exclusive jurisdiction that is unfavorable to the consumer will have no effect.
- These Terms and disputes between the Company and Users are governed by the laws of the Republic of Korea.
Supplementary Provisions
These Terms take effect on July 28, 2026.
Part 2. Refund and Cancellation Policy
Article 1 (Purpose)
The purpose of this Policy is to establish the standards and procedures for cancellations and refunds of Reservations for the Services provided by the Company.
Article 2 (Right of Withdrawal)
Pursuant to Article 17 of the Act on Consumer Protection in Electronic Commerce, Etc., a User may withdraw from a Reservation within 7 days from the date the User receives a written document confirming the Reservation. However, this does not apply where any ground for restricting the right of withdrawal under Article 17(2) of the same Act applies, and the Company will inform the User of such restriction when confirming the Reservation.
Article 3 (Cancellation and Refund Standards)
- If a User cancels due to a simple change of mind, the Company will deduct the cancellation fee and issue a refund based on the following standards, calculated backward from the date of use:
- a. Up to 7 days before the date of use: 100% of the payment amount refunded
- b. From 6 to 4 days before the date of use: 50% of the payment amount refunded
- c. From 3 days before the date of use through the date of use: No refund
- If the Service cannot be provided due to force majeure for which neither the Company nor the User is responsible, including a natural disaster or severe weather, the Company will refund the full payment amount or consult with the User to reschedule the Service.
- If the Service is not provided due to a cause attributable to the Company or the Local Operator, the Company will refund the full payment amount and compensate for damage in accordance with applicable laws and regulations.
Article 4 (Refund Procedure and Timing)
- In principle, a refund will be processed using the same payment method used by the User.
- The Company will initiate the refund procedure within 3 business days from the date it confirms the reason for cancellation and refund. However, additional time may be required for the refund to be completed depending on the processing schedule of the payment gateway or card issuer.
Part 3. Travel Terms and Conditions
Article 1 (Purpose)
The purpose of these Travel Terms is to establish the conditions for using the travel-related services provided by the Company, including Directly Provided Services and Brokerage Services, as well as the rights and obligations of the Company and Users.
Article 2 (Parties)
For Directly Provided Services, the party to the travel contract is the Company, PADATOUR INC. (주식회사파다투어). As a comprehensive travel business operator, the Company entrusts reservation processing and local operations management in Japan to the Local Operator, 株式会社PADA, and the Local Operator acts as the Company's assistant in performance. For Brokerage Services, the Company is a mail-order intermediary and is not a party to the transaction.
Article 3 (Changes to the Itinerary)
- If an itinerary change is unavoidable due to force majeure, including a natural disaster, severe weather, or local circumstances, any resulting additional costs will be borne by the User, and any resulting cost savings will be returned to the User.
- If an itinerary is changed due to a cause attributable to the Company, the Company will bear the resulting additional costs.
Article 4 (Safety and Liability)
- The Company and the Local Operator will exercise the duty of care necessary to ensure User safety.
- The Company bears contractual liability for accidents occurring in the course of providing Directly Provided Services, and the internal allocation of liability with the Local Operator is governed by the outsourcing agreement.
- The Company's liability may be reduced or excluded for an accident caused by a User's failure to follow the safety rules or legitimate instructions of the Company or the Local Operator.
Article 5 (Insurance and Mutual Aid)
In connection with its comprehensive travel business registration, the Company has enrolled in the Korea Association of Travel Agents' business guarantee (mutual aid) pursuant to the Tourism Promotion Act. The amount of coverage under the mutual aid program (business guarantee) is KRW 50,000,000.
Article 6 (Portrait Rights)
If the Company wishes to use a User's photographs or videos taken during a tour for promotional purposes, it will obtain the User's prior consent on an opt-in basis, and the User may withdraw that consent at any time.
Part 4. Cookie Policy
Article 1 (Use of Cookies)
The Company may use cookies to provide customized services to Users. Cookies are divided into strictly necessary cookies required for operation of the Site and cookies used for analytics and marketing purposes.
Article 2 (Consent and Installation)
- Strictly necessary cookies are installed only to the extent essential for providing the Services.
- Analytics and marketing cookies are installed and operated only after obtaining the User's prior consent. The Company operates a cookie consent banner on the Site so that Users can accept or reject the use of cookies.
Article 3 (Rejecting Cookies)
A User may reject the storage of cookies or delete cookies through the settings of the User's web browser. However, rejecting the storage of strictly necessary cookies may restrict the use of certain Services.
